Overview:
The Retail and Commercial Leases (Miscellaneous) Amendment Bill 2017 was presented to Parliament in July 2017. The Bill subsequently lapsed due to Parliament rising for the 2018 State Government election. However, if re-introduced and passed, the reforms contemplated by the Bill would have a direct impact on commercial leasing practice. This session will cover legislative developments in respect of the Retail and Commercial Leases Act 1995, from the Retail and Commercial Leases Regulations 2010 (and the highly controversial increase in the prescribed rent threshold effected by these Regulations, including the subsequent Supreme Court cases) to the Moss Review of the Retail and Commercial Leases Act 1995 in 2016 and the Retail and Commercial Leases (Miscellaneous) Amendment Bill 2017 that was introduced to Parliament following the Moss Review.
