SACAT's Expanding Jurisdiction

As of today, 22 February 2018, SACAT has been conferred jurisdiction by the Statutes Amendment (SACAT No 2) Act 2017 under the following acts:

·       Agricultural and Veterinary Products (Control of Use Act) 2002
·       Associations Incorporation Act 1985
·       Co-operatives National Law (South Australia) Act 2013
·       Environment Protection Act 1993
·       Petroleum and Geothermal Energy Act 2000
·       Petroleum Products Regulation Act 1995
·       Primary Industry Funding Schemes Act 1998.

On Monday 26 February 2018, SACAT will be conferred jurisdiction by the Children and Young People (Safety) Act 2017.

Law Council of Australia's address to the National Press Club
"Justice State of the Nation" - 14 March 2018 

The President of the Law Council, Mr Morry Bailes will address the National Press Club, including as to the findings of the Law Council’s 2017 Justice Project. 
 
Members are encouraged to watch the presentation, which will be shown live on ABC TV, the speakers commencing at 12 noon, SA time. 

SA Mental Health Strategic Plan 2017- 2022

The South Australian Government has released its SA Mental Heath Strategic Plan 2017-2002, which identifies a 20-year vision for building, sustaining and strengthening the mental health and well being of South Australians.

Commencement of the Children and Young People (Safety) Act 2017

The Society notes that a number of sections of the Children and Young People (Safety) Act 2017 will commence on 26 February 2018, with the second phase of commencement to occur on 22 October 2018. The February commencement of provisions includes:

  • Sections 4-5: The importance to the State of children and young people
  • Sections 7-9: Priorities in the operation of the Act:
    • Safety of children and young people paramount
    • Other needs of children and young people
    • Wellbeing and early intervention
  • Sections 10-12: Principles to be applied in the operation of the Act:
    • Principles of intervention
    • Placement principles
    • Aboriginal and Torres Strait Islander Child Placement Principle
  • Section 13: Charter of Rights for Children and Young People in Care
  • Sections 14-15: Additional functions of Minister
  • Section 20: Minister may establish Child and Family Assessment and Referral Networks
  • Section 59: Onus on objector to prove order should not be made
  • Section 62: Views of the child or young person to be heard
  • Sections 65-66: Conference of parties and right of other interested persons to be heard
  • Sections 78-83: Information and involvement in decision-making
    • Approved carers to be provided with certain information prior to placement
    • Children and young people to be provided with certain information prior to placement
    • Approved carers to be provided with certain information
    • Approved carers entitled to participate in decision-making process
    • Non-compliance with Division not to invalidate placement
  • Section 96: Voluntary custody agreements
  • Section 110A: Persons not to be employed in certain residential facilities established under Family and Community Services Act 1972
  • Section 112: Minister to arrange assistance for eligible care leavers

2018 Mock Trial Competition 
Coaches and Mock Judges Required



The Law Society of South Australia is once again coordinating the Mock Trial Competition for South Australian secondary schools in 2018, sponsored by the Law Foundation of South Australia. The Society is seeking expressions of interest from our Members who could volunteer their time for the benefit of senior secondary students as a Coach or to Judge the Mock Trials. Coaching has an upper limit of three hours per round and can be done in person or by conference call. We hope many Members will make themselves available again this year for this lively and worthwhile competition.

Do You Qualify for a Grant

The Law Foundation of South Australia Incorporated is Inviting Applications for Grants.

Established in June 1985 as a non-profit organisation, a major function of the Foundation will be the making of GRANTS to persons and/or bodies who are taking part or wish to take part in activities consistent with the Foundation’s objectives.
 
Its objectives include: 
  1. the support of legal research which is of value in law reform,
  2. the promotion and provision of legal education and information for legal practitioners, students and members of the public,
  3. the promotion of community education in law and the  legal system,
  4. the provision of legal services to the community. 
The Foundation is chaired by a Supreme Court judge and is comprised of members representing the public, the Law Society of South Australia and the Law Faculties of the University of Adelaide, Flinders University and University of South Australia.
 
The Foundation may attach conditions to grants where appropriate.

LAWASIA 7th Family Law and Children's Rights Conference
