The Law Society’s Country Practitioners' Committee are excited to invite you to CPD in the Vines, a comprehensive CPD conference set in the beautiful Barossa Valley!

The event kicks off at 9:00am with a series of six tailored sessions covering essential topics such as succession law, family law, retail and commercial leases, neighborhood disputes, and superannuation. Each session is designed to address the unique topics most relevant to country practitioners.

After the insightful sessions, join us for a networking opportunity over post-conference drinks and tastings, where you can connect with peers and unwind.

The day will culminate with a delightful Conference Dinner starting at 6:30pm, featuring a sumptuous three-course banquet menu and beverage package.

Session 1: An Overview of the New Succession Act
Presenter:

In this session, the presenters will provide a comprehensive overview of the new Succession Act, set to take effect on 1 January 2025. They will specifically address the key provisions of the new legislation and the changes it will introduce, helping lawyers prepare for its implementation. The session will also cover the draft changes to the Uniform Civil Rules, which will replace the Probate Rules 2015.

Session 2: Exploring the Retail and Commercial Leases Act 1995 (SA)

This session will explore South Australia’s key legislation governing commercial leases. Our expert speaker will summarise the history, philosophy and application of the Act as well as alerting attendees to the Act’s critical provisions. The session will benefit practitioners that act for Landlords or Tenants, as well as those that advise Vendors, Purchasers and Financiers of land or business.

Session 3: Managing Neighbourhood Disputes

Every legal practitioner inevitably ends up with clients who fall into dispute with their surrounding neighbours or, indeed, the local council, arising from the proposed and actual use or development of neighbouring land. This session discusses strategies to attempt to minimise disputes from occurring at all, and when disputes do arise, how to attempt to resolve them in as practical a manner as possible in the South Australian Courts.

Session 4: Dealing with Superannuation Death Benefit Claims Against Large Superannuation Funds

This session will provide guidance for practitioners engaged to deal with superannuation death benefit claims by dependants or executors/administrators of a deceased estate.  There has been increased recent activity occurring in this space, including where complaints are lodged with the Australian Financial Complaints Authority (AFCA).  Delegates will be provided with practical tips for dealing with these matters, and recent trends in decisions made by AFCA and the courts will be addressed.

Session 5: Family Violence in Family Law Parenting Proceedings

Senior Judicial Registrar Jacqueline Schirripa, Federal Circuit and Family Court of Australia

In this session, the presenter will consider and outline the amendments to the Family Law Act, as well as addressing the response from the Federal Circuit and Family Court of Australia as to family violence and other safety issues.

Session 6: The Duties and Responsibilities of a Solicitor in Succession Law

This session will explore the key obligations for practitioners in considering issues of testamentary capacity, with a focus on suspicious circumstances when preparing will, particularly when dealing with aged testators. The presenter will also cover the duty to a ‘disputed beneficiary’ and offer practical guidance on managing these challenges.
