This session considers some trust deed provisions which can significantly affect trustee liabilities, risks, taxation and stamp duties. The paper challenges the conventional wisdom around drafting broad beneficiary clauses and outlines the potential disadvantages of these clauses. It also considers some of the rules around trustee powers, the proper law of a deed and potential tax consequences of being considered a foreign trust. Finally, we look at how accountants deal with inter vivos and testamentary trust deeds and how drafting impacts on this.

About the Presenter:
SME Chartered Tax Advisor of the year for 2017, Julie Van der Velde STEP is the founder of VdV Legal, a specialist commercial law practice in the Adelaide CBD. VdV Legal specialises in taxation law and wealth management structures, providing tax and equity opinions and advices. She has significant experience advising on business succession, estate planning and restructuring. Julie has recently been appointed Chair of STEP Australia.
