This half day Civil Law Intensive will contain three sessions surrounding counselling clients and dealing with self-represented litigants, breaking deadlocks, and cost considerations in litigation.
Program:
Working with Self Represented Litigants
Session 1: 3:00pm - 4:00pm
Presenter: Margaret Castles & Thomas Cadd, University of Adelaide - Adelaide Legal Outreach Services
CPD: 1 CPD unit (Professional Skills)
This session draws on experience at the University of Adelaide Free Legal Advice Clinics that provide step in step out advice to unrepresented litigants. We will discuss how to manage client expectations, how to counsel clients about their options, and how to support clients to engage with other parties. We will also comment on communication and conduct of solicitors acting against self-represented litigants.
Breaking Deadlocks
Session 2: 4:15pm - 5:15pm
Presenter: Ruth Beach - Mediator
CPD: 1 CPD unit (Professional Skills)
There are times in mediation when the parties are intransigent, the gap between them is too wide and there appears to be no way to resolve the matter outside of the trial. In this presentation, Ruth Beach will explore the myriad of options available which can assist resolution when the parties appear to be deadlocked.
An overview of cost considerations in litigation
Session 3: 5:15pm - 6:15pm
Presenter: Shavin Silva, Crown Solicitor's Office
CPD: 1 CPD unit (Practical Legal Ethics)
This session will aim to give attendees an overview of the various costs considerations a solicitor must confront in the context of litigation, with an emphasis on commercial litigation, from engagement onwards.
