For centuries the notion that an "Englishman's land is his castle" was jealously guarded by landowners who were uncompromising in the protection of their freehold ownership, which they believe gave them exclusive and inalienable rights to the quiet enjoyment of their properties. However, as the mining law developed it became apparent that the freehold landowner was on a collision course with the miner.
