The discretion given to practitioners by S269W of the Criminal Law Consolidation Act  is a broad one.  What are its limits?  When can it be exercised?  When is a client ‘unable to instruct counsel’?  What if the client instructs counsel not to exercise the discretion?  These and similar questions will be discussed by the Legal Services Commission’s Chief Counsel Greg Mead SC.
