New Collective Bargaining Exemptions In Commerce (B2B) For SME’s

In June of 2021 the ACCC issued guidelines as to exemptions for three classes of businesses that enables each of those classes to engage in collective bargaining arrangements with other businesses, such as suppliers and business customers.

A business that is within the scope of these exemptions has automatic protection from risk of breaching competition laws by engaging in such activities, subject to qualifying for the exemption. One class is any business or independent contractor with an aggregated turnover of less than 10 million in the most recent financial year.  This CPD deals with this determination by the ACCC to make these class exemptions, how it is anticipated the exemptions will operate and create a commercial  benefit to such classes, and general commentary on the same. The ACCC has kindly agreed to participate in this CPD. This CPD will be of interest to anyone that advises SME’s.
