This session identifies the errors which are resulting in claims against South Australian commercial litigation practitioners. Using case studies, based on Law Claims files, we will explore issues such as cost and time pressures, difficult clients, the vagaries of litigation, broad practice areas, increasing regulation, advocates’ immunity, inadvertent waiver of privilege and cyber risks. Commercial litigation has inherent risks, but you can do a lot to protect yourself as well as your client.

We will examine Law Claims’ civil litigation claims over the past 5 years, identifying problematic areas and highlighting the importance of establishing good processes, clear communication standards and appropriate policies. When we understand the real causes of claims and accept that we all make errors, it becomes clear that ‘blaming and shaming’ does not solve problems. This seminar which includes video input from Dr Peter Lee – Consultant in healthcare communication and Human Factors, will encourage us view human error in a different light so that we can anticipate and avoid poor client and firm outcomes.
