Tools and Practical Resources

The Law Society of South Australia has developed practical tools and resources to assist legal practitioners in understanding the professional, ethical and practical considerations that arise when using artificial intelligence in legal practice.

Practitioners should also be aware that courts, tribunals and regulators are continuing to develop guidance on the use of AI. Where AI is used in litigation or tribunal work, practitioners should check the requirements of the relevant court or tribunal, including any obligation to verify AI generated material, disclose AI use, or ensure that affidavits, witness statements and expert evidence remain the work of the person giving that evidence.

The Society will continue to update this hub as further guidance, tools and resources become available.

An interactive tool to help legal practitioners identify key professional, ethical and practical considerations when using AI in legal practice, including tailored guidance on confidentiality, verification, court and tribunal obligations, vendor questions, record keeping and implementation planning.

AI Selection and Use Checklist

A practical checklist to help legal practices assess, select and implement third party AI tools, with prompts covering confidentiality, privacy, vendor terms, supervision, accuracy, staff training, record keeping and ongoing review. The checklist is directed at small and mid-tier firms considering AI tools supplied by external providers and focuses on whether client confidentiality can be protected and whether AI assisted work can be safely relied upon under appropriate human oversight.

Client Alert - Use  of AI Platforms & Legal Advice

A client alert that legal practices can provide to clients to explain the risks of using AI platforms in connection with a legal matter. It covers confidentiality, legal professional privilege, privacy, cybersecurity, accuracy and the potential for increased legal costs, while encouraging clients to discuss the responsible use of AI with their lawyer.

Sample AI Policy for Law Practices

A sample policy from LawCover to help law practices set expectations for the responsible use of generative AI by solicitors and support staff.
