It is common for lawyers to be asked to act as executors. Executors have significant and lasting responsibilities, and there are a number of potential pitfalls, especially over charging and exposure to personal liability. The presentation will look at those problems from the context of a lawyer’s professional and ethical responsibilities and an executor’s duties, with reference to case law.

Topics will include:
- The Duties ‘to the Court’, to the client, and to the beneficiaries
- Identifying the client, and how to deal with conflicting interests and instructions
- Fees – authority, scope and informed consent
- Communication
- Discharge from administration
