This practical presentation will focus on the rules, processes, and case law for setting aside Judgment in the Magistrates Court in SA. Too often people omit to respond to a claim until it is too late, and the Applicant signs judgment against them. Then, it’s a mad scramble to show good reason why judgment should be set aside, and get a proposed defence in order.
This presentation focuses on the practical steps needed to achieve this outcome, and reviews recent case law to provide some sense of the criteria that the judiciary will use when exercising discretion to set aside judgment in civil courts in SA.
