Willmakers occasionally include declarations about other people in their will which the subject might find offensive. Sometimes this is done to explain unequal distribution or lack of provision, but it might also be done to simply have the final say about the character or lifestyle of the person in question. The Court is generally reluctant to interfere with a will but words may be struck out if they are deemed to be adequately offensive. This presentation will explore how and where the Court draws the line to declare such statements so offensive that they must be excluded from the probate copy of the will.
