When it comes to drafting errors, Law Claims subscribes to the old adage, “learn from the mistakes of others – you won’t live long enough to make them all yourself!” In this seminar we see a wise hypothetical firm after a claim and several near misses. The firm has set up a risk management group to consider where they are vulnerable to drafting problems and put in place strategies to reduce their risks across all areas of practice. The claims prone issues explored include human error, failure to road test, not drafting to meet regulatory requirements and incomplete research before drafting. We will see that small changes can make the world of difference.

This seminar is an opportunity to review and reset your risk management strategies in your wills and estate practice. The case studies will highlight challenging and claims prone areas including capacity, undue influence and blended families. With the assistance of Jennifer Brook, Director Sedsman Legal  and Grant Feary, Legal Risk Counsel Law Claims, we will examine a number of case studies, consider the guidance provided by the Wills and Estates Risk Package and ensure that you are doing everything to protect the ‘will’ of your client and your firm from claims.

PI Scheme Participants admitted more than 3 years: $110 per session
PI Scheme Participants admitted less than 3 years: $85 per session

Cancellation and Payment Terms: Registration fee payment is required in full at the time of registration. Previously paid registrations are transferable subject to the alternate attendee being eligible to register at the same registration fee (that is a practitioner who is not a Society member is not eligible to attend in place of a member without the price differential having been paid. Any person who has registered and paid to attend an event but is subsequently unable to do so and does not wish to transfer the registration is able to apply to the Society for a refund, however such refunds (in whole or in part) will be at the discretion of the Law Society subject to the circumstances and any external costs paid by the Society which cannot be recovered by us. Where there are event specific cancellation and/or payment terms published, those terms override any conflicting terms specified here.
